1. Introduction
This website (www.digimart.ng) is owned and operated by Digimart NG Concepts, a company registered under the laws of the Federal Republic of Nigeria (“Digimart NG”, “we”, “us” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Digimart NG website, web app and related services (together, the “Platform”).
By creating an account, funding your wallet or making a purchase on the Platform, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.
2. Our services
Digimart NG is a digital products marketplace that lets you:
- buy airtime and mobile data for Nigerian networks (MTN, Airtel, Glo, 9mobile);
- pay electricity bills (prepaid tokens and postpaid accounts);
- renew cable TV subscriptions; and
- buy other digital PINs and vouchers that we may offer from time to time.
These services are fulfilled through licensed third-party service providers and aggregators. Digimart NG is not a bank, a mobile network operator, an electricity distribution company or a cable TV operator.
3. Eligibility and your account
- You must be at least 18 years old and able to enter into a binding contract under Nigerian law.
- You must give accurate, current and complete information when you register, and keep it up to date.
- Each person may hold only one account. Accounts are personal and may not be sold, transferred or shared.
- You are responsible for keeping your password and 4-digit wallet PIN confidential, and for all activity on your account. Tell us immediately at support@digimart.ng if you suspect unauthorised access.
4. Identity verification (KYC)
To receive a dedicated virtual bank account for wallet funding, you must complete identity verification using your Bank Verification Number (BVN) and the details we request. This is required by our payment partners and by Nigerian anti-money-laundering and know-your-customer regulations. We may refuse, limit or suspend wallet funding where verification cannot be completed or the information provided appears false.
5. Wallet and funding
- Your Digimart wallet is a prepaid balance used only to pay for services on the Platform. It is not a bank account or savings product, does not earn interest, and is not covered by deposit insurance.
- You can fund your wallet by bank transfer to your dedicated virtual account or by card, through our licensed payment partners. Where available, card payments are processed by our payment partner; we do not see or store your full card details.
- Payment partners charge a processing fee on wallet funding. The amount credited to your wallet is the amount you paid less the applicable processing fee, which is shown on your funding receipt.
- Funding is credited once we receive confirmation from the payment partner. Delays caused by banks or payment partners are outside our control.
- Wallet balances cannot be transferred to another user and are intended for purchases on the Platform. Refunds of an unused balance to a bank account are not guaranteed and are considered on request through support, subject to identity verification, applicable law and the payment partner’s transfer charges.
6. Purchases, pricing and delivery
- Prices are shown in Nigerian Naira (₦) before you confirm a purchase and may change without notice.
- You are responsible for entering the correct phone number, meter number, smartcard/IUC number, network and plan. Purchases delivered to details you entered cannot be reversed or refunded.
- Every wallet purchase requires your wallet PIN. A purchase confirmed with your PIN is treated as authorised by you.
- Most purchases are delivered within seconds, but delivery depends on the network, utility or operator. Occasional delays may occur.
- If a purchase fails and is not delivered, the amount is refunded to your Digimart wallet. Purchases shown as “pending” are resolved once we receive a final status from the provider.
- Electricity tokens, data bundles and subscriptions are subject to the terms of the relevant network, utility or operator.
7. Complaints and disputes
If something goes wrong, raise a support ticket from your dashboard (quoting the transaction reference), use the contact form on our homepage, or email support@digimart.ng. Please report issues within 7 days of the transaction. We will investigate with the relevant provider and respond as quickly as possible. Where we confirm that a service was not delivered, we will refund your wallet.
8. Prohibited use
You must not use the Platform to:
- commit fraud, money laundering, terrorism financing or any other unlawful activity;
- fund your wallet with stolen cards, compromised bank accounts or funds that are not yours;
- raise false chargebacks or disputes for services you received;
- exploit bugs, pricing errors or system glitches for gain (you must report them to us instead);
- use bots, scripts or automated tools to access the Platform without our written permission; or
- interfere with the security or operation of the Platform or attempt unauthorised access to any account or system.
9. Suspension and termination
We may suspend, restrict or close your account, reverse credits obtained in error, or withhold balances where we reasonably suspect a breach of these Terms, fraud or unlawful activity, or where we are required to do so by law, a regulator or a payment partner. You may close your account at any time by contacting support. Any legitimate unused balance will be handled in line with Section 5.
10. Intellectual property
“Digimart NG”, “DigimartNG”, our logos and the content and software of the Platform are owned by Digimart NG Concepts or its licensors. You may not copy, modify, distribute or use them without our prior written consent. Network, utility and operator names and logos belong to their respective owners.
11. Third-party services
The Platform relies on third parties such as payment partners, service aggregators, network operators, utilities, cable operators, email providers and Google sign-in. Their services are governed by their own terms, and we are not responsible for their acts, omissions or downtime, although we will help you resolve any issue affecting your purchase.
12. Disclaimer and limitation of liability
The Platform is provided on an “as is” and “as available” basis. We do not guarantee that it will always be uninterrupted or error-free. To the fullest extent permitted by Nigerian law, Digimart NG shall not be liable for any indirect, incidental or consequential loss (including loss of profit, data or business opportunity). Our total liability for any claim relating to a transaction is limited to the amount you paid for that transaction. Nothing in these Terms limits any liability that cannot be limited under applicable law.
13. Indemnity
You agree to indemnify Digimart NG Concepts, its directors and staff against any claim, loss or expense arising from your breach of these Terms, your misuse of the Platform or your violation of any law or third-party right.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Material changes will be communicated on the Platform or by email. Continuing to use the Platform after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. We will first try to resolve any dispute amicably. If that fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria.
